dc.description.abstract	El presente artículo de revisión pretende evidenciar la falta de regulación del novedoso derecho a la desconexión laboral en Colombia dentro de la modalidad del teletrabajo, teniendo en cuenta que esta modalidad se instauró con la llegada de las tecnologías digitales y de la comunicación en el año 2008, y que no fue hasta el año 2022 que se reguló este derecho a la desconexión laboral, si bien Colombia fue uno de los precursores en regular este derecho se destaca que la pandemia de la COVID19 fue un factor fundamental para la regulación de este, aun así, sigue siendo tenue la normativa frente a este nuevo derecho. El presente artículo revisa esos factores problemáticos de este nuevo derecho como por ejemplo; primero, revisar si la disposición extra jornada laboral merece o no una remuneración adicional al trabajador, segundo, si de ser el caso el empleador merece o no una sanción por vulnerar este derecho de desconexión, tercero, observar si la norma actual de desconexión laboral cumple con las necesidades de los teletrabajadores, cuarto, revisar con qué medios de protección cuenta el teletrabajador para garantizar su derechos a la desconexión laboral. Por lo tanto, se invita al lector a que revise con ojos críticos y constructivos este nuevo derecho del ordenamiento jurídico, con ello que se logre aportar desde la academia al legislador y al gobierno nacional para que regule e impulse de manera eficaz este derecho de desconexión, teniendo en cuenta los cambios cada vez más rápidos de la tecnología y de las cuales debe existir una respuesta normativa igual de rápida y efectiva para que no se vulneren derechos a los teletrabajadores de ahora y del futuro.
dc.description.abstractenglish	This review article aims to highlight the lack of regulation of the new right to disconnect from work in Colombia within the teleworking modality, taking into account that this modality was established with the arrival of digital and communication technologies in 2008, and that it was not until 2022 that this right to disconnect from work was regulated. Although Colombia was one of the precursors in regulating this right, it is highlighted that the COVID19 pandemic was a fundamental factor in its regulation, even so, the regulation regarding this new right remains weak. This article will review the problematic factors of this new right, such as: first, to review whether or not the provision of extra working hours merits additional remuneration for the worker; second, if this is the case, the employer deserves or does not deserve a sanction for violating this right to disconnect; third, to observe whether the current norm of work disconnection meets the needs of teleworkers; fourth, to review what means of protection the teleworker has to guarantee his right to work disconnection. Therefore, the reader is invited to review this new right of the legal system with critical and constructive eyes, thereby achieving contributions from academia to the legislator and the national government to effectively regulate and promote this right to disconnect, taking into account the increasingly rapid changes in technology and for which there must be an equally rapid and effective regulatory response so that the rights of workers of now and of the future are not violated.
